Consignment Agreement

The terms under which Rippex Card Vault accepts, markets and sells consigned trading cards and collectibles.


1.Definitions

For this Agreement:

2.Appointment

The Consignor appoints Rippex as a non-exclusive sales agent to market and sell the Consigned Items.

Ownership remains with the Consignor until legal title passes to the purchaser. Nothing in this Agreement transfers ownership of the Consigned Items to Rippex.

3.Ownership and Authority

The Consignor confirms they are the legal owner of the Consigned Items, or have authority to consign them.

Rippex may refuse any item where ownership or authenticity cannot reasonably be established.

4.Authenticity

The Consignor confirms all information supplied is accurate and that, to the best of their knowledge, submitted items are genuine.

Rippex reserves the right to refuse, return or withdraw from sale any item believed to be counterfeit, altered, misrepresented or otherwise unsuitable.

5.Shipping and Receipt

The Consignor is responsible for securely packaging items and arranging appropriate shipping.

Risk remains with the Consignor until Rippex physically receives and accepts the shipment. Submitting a consignment form does not constitute confirmation of receipt.

Rippex will issue a receipt confirmation following inspection.

6.Inventory Verification

Quick Consign submissions act as shipment notifications only. Detailed Consign submissions assist identification but do not replace Rippex's own inventory verification.

The Consignor should retain photographs, shipping evidence and inventory records until Rippex confirms the received inventory.

7.Selling Authority

Rippex may market items through approved channels including Card Hobby, eBay, Whatnot, Fanatics, Goldin, Alt, direct sales or other suitable marketplaces.

Unless a specific minimum is agreed with the Consignor in writing, items are listed at auction starting from £1 with no reserve. For higher-value items, an estimated value, reserve or pricing approach is agreed with the Consignor directly before listing. Where a minimum has been agreed, Rippex will not knowingly sell below that amount without the Consignor's approval. The final selling route and pricing are confirmed with the Consignor once the consignment has been received and processed.

8.Seller Conduct

The Consignor must not bid on, purchase, or otherwise attempt to artificially influence the sale price or outcome of their own Consigned Items, whether directly or through another person acting on their behalf. This includes shill bidding of any kind, which also breaches marketplace rules and may be unlawful.

Any such activity is a material breach of this Agreement. Rippex may cancel the consignment, end affected listings, withhold proceeds related to the affected transaction, and recover from the Consignor any costs, fees or losses incurred as a result.

9.Fees

Rippex charges:

The Rippex fee is subject to a minimum of £2.50 per card, applied where the percentage fee would otherwise come to less. Rippex does not charge its fee on postage, or on buyer-side marketplace or platform fees.

10.Third-Party Costs

Third-party marketplace, payment processing, currency conversion, shipping, insurance, and other external fees are deducted at cost from sale proceeds.

Rippex will not apply any hidden markup to these costs.

11.Payouts

Payouts are calculated as: Card Sale Price, plus any postage charged to the buyer, less the Rippex Fee, less Third-Party Costs, equals Final Payout.

Rippex will normally issue payout within five working days after cleared funds have been received. Written confirmation showing the sale price, the deductions applied and the amount paid accompanies every payout.

12.Buyer Returns and Chargebacks

Until the Consignor’s payout has been made, buyer disputes, refunds or chargebacks may affect the proceeds from that sale.

Once the Consignor's payout has been made it is final. If a buyer subsequently returns the item, the returned item becomes the property of Rippex and the Consignor keeps their payout.

13.Unsold Items

Unsold items may be returned upon request. Return shipping costs are the responsibility of the Consignor unless otherwise agreed.

Rippex may charge reasonable storage fees where items remain uncollected after reasonable notice.

14.Offers to Buy Your Items

Rippex may, at any time, offer to buy any of your consigned items outright rather than continue selling them on your behalf. Each offer states a price for each item and how long it is open for.

You are under no obligation to accept. You may accept an offer on some items and decline it on others, or decline it entirely, and declining has no effect of any kind on your consignment: those items continue to be sold on your behalf under these Terms, at the same fee and at the same stage, with nothing recorded against you.

Where you accept, the items you sold come off your consignment on the day Rippex pays you. No consignment fee is charged on them, because they were not sold on your behalf. Ownership of those items passes to Rippex when payment is sent and not before.

While an offer is open, Rippex holds the items it covers rather than listing them, so that an item cannot be sold on your behalf and bought by Rippex at the same time. If you decline, or the offer closes unanswered, they return immediately to the stage they were at.

Offers to buy are governed by the QuickOffer™ Terms, which apply to the purchase itself; these Terms continue to govern everything that remains on consignment.

15.Care of Items

Rippex will exercise reasonable care while items remain in its possession.

Subject to applicable law, Rippex's liability for loss or damage while items are in its custody shall not exceed the item's proven fair market value.

16.Limitation of Liability

Rippex shall not be liable for indirect, consequential or economic losses, market fluctuations, grading outcomes or events beyond its reasonable control except where liability cannot lawfully be excluded.

17.Data Protection

Rippex processes personal information in accordance with its Privacy Notice and applicable UK data protection legislation.

18.Electronic Signature

Typing a name and submitting the online consignment form constitutes an electronic signature.

Rippex records the accepted terms version, submission timestamp and related audit information.

19.Amendments

Rippex may update these terms from time to time. The version accepted at the time of submission will apply to that consignment unless otherwise agreed.

20.Governing Law

This Agreement is governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
